Gaines and Morrisey Call for Protection of Women’s Sports Against Biden Administration Challenge

Former NCAA athlete Riley Gaines and West Virginian Attorney General Patrick Morrisey have spoken out about their fight to protect fairness in women’s sports. They argue that common sense has become less common, as males self-identify into female locker rooms, prisons, and athletic competitions across the country. The duo discussed this issue because recently the Fourth Circuit ludicrously found that keeping females out of male events violates Title IX, a statute meant to protect women’s educational opportunities including sports. They argue that this decision goes against what most people consider common sense as males can significantly alter an athlete’s overall competitiveness in female athletics due to differences between men and women such as strength, size, and speed.
Morrisey is now signing the Independent Women’s Voices Stand with Women Commitment, which promises that he will fight for defending women’s equal opportunities and private spaces while in office or whenever necessary. He believes that West Virginia should define sex-based terms like men and women, male and female to clarify these concepts are rooted in biology rather than self-identification. Morrisey argues that the Biden administration does not have authority over defining “sex” as it allows males into female opportunities such as education, athletics, or private spaces, putting women at risk of assaults and physical injuries due to innate differences between men and women.
The duo’s concerns are supported by multiple states banning transgender student athletes from competing in females-only sports teams for protecting girls and women. However, the Biden administration claims that “transgender girls” (meaning boys) who compete against biological females do not threaten athletic opportunities or cause harm to them as they claim HB 3293’s prohibition of transgenders from participating in female-only sports teams causes harm due to sexual difference between women and men. However, the Biden administration might implement similar rulings once implemented because its recent final Title IX regulation rewrite indicates such a possibility by turning “sex” into an undefined term that can be used interchangeably with gender identity or expression.
