The state of Texas has filed a lawsuit against President Biden’s administration over recently announced federal protections for LGBTQ+ students, claiming the Department of Education exceeded its authority by broadening the scope of an existing anti-sex discrimination law. The legal action was initiated on Monday in Amarillo, ensuring it falls under Judge Matthew Kacsmaryk, a conservative who has issued injunctions against several federal policies and is known for his hardline stance on abortion rights. Texas Attorney General Ken Paxton wants the judge to block Biden’s administration from implementing changes to Title IX – passed into law in 1972 to prevent sex-based discrimination at institutions that receive Federal funds – as it contravenes federal rulemaking procedures, according to court documents seen by CNN. The new policy targets behaviour that marginalizes transsexual or intersex persons because they “breach” gender norms and is due for implementation in August 2021. In the lawsuit’s filing, Texas claimed its educational institutions would suffer irreparable damage as Federal funds account for an indispensible source of financial backing since decades-long interpretations regarding Title IX were at variance with ‘sexual orientation,’ ‘gender identity’, and ‘sex characteristics.’ The Department of Education has yet to comment on the matter. Earlier this year, a proposal was issued by policymaking bodies in federal judiciary seeking to curb judge shopping – where litigants attempt deliberately placing suits within precincts assumed for supporting specific opinions’ courts they think are most receptive. In line with its recent efforts aimed at shielding the LGBTQ+ community from abuse and harassment, last week President Biden announced a raft of reform measures in health care designed to reinforce anti-discrimination safeguards – part of which will see an overhaul on existing legislation under Title XIX – were also initiated just one day prior. While speaking during the unveiling ceremony, Xavier Becerra – US Health and Human Services Secretary – said: “These actions are a giant step forward for this country toward a more equitable and inclusive health care system.”
