Former President Donald Trump and Republican lawmakers have outlined a multi-faceted plan to dismantle many of the federal rules imposed under President Joe Biden should they regain control of the government in November. This plan includes actions by Trump through executive orders, joint efforts by Trump and Congress via the Congressional Review Act, and legislative reforms by Republican lawmakers. Specifically, Trump aims to revise, revamp, and eliminate Biden-era rules through executive orders, while Congress and Trump collaboratively intend to reverse rules passed during Biden’s last year using the Congressional Review Act. Additionally, Republican lawmakers will propose legislation aimed at reforming the rulemaking and approval process itself, including bills like the REINS Act and the Sunset Act, which aim to give Congress greater oversight over agency rulemaking. These proposals reflect the growing Republican consensus on the need to tackle what they call “the administrative state,” a term used to describe executive branch agencies that have the power to write and enforce rules with little input or direction from Congress. If they succeed in gaining control of the government, experts predict that this effort could lead to the most significant reworking of the administrative state in recent history.
