Most Astroworld Lawsuits Settled, Only One Wrongful Death Case Remains

Nearly all of the lawsuits stemming from the tragic Astroworld festival in 2021 have been settled, according to recent announcements made in court. Nine out of the ten wrongful death lawsuits, including one that was scheduled to go to trial this week, have been settled, including one filed by the family of Madison Dubiski, a 23-year-old woman who lost her life during the deadly crowd surge. The settlement terms are confidential, and lawyers involved in the cases have declined to comment due to a gag order. However, it has been revealed that the lawsuit filed by the family of Ezra Blount, a 9-year-old boy who was the youngest victim of the tragedy, remains pending, and a meeting has been scheduled for next week to determine when the case can proceed to trial. More than 4,000 people filed over 300 injury claims following the event, and about two-thirds of these injury cases still await resolution. The announcement of the settlements was made after a delay in the trial of the Dubiski case, which occurred after Apple Inc. Appealed against a court decision that rejected their plea for dismissal from the case. Following the delay, the family of Madison Dubiski reached a settlement with all parties involved in the lawsuit, including Apple, Travis Scott, and Live Nation, the biggest promoter of live events globally. Four wrongful death lawsuits had already been settled and publicly disclosed prior to this announcement. In previous legal filings, lawyers for the deceased’s families, as well as attorneys representing the various plaintiffs, have accused the organizers of neglectful planning and a lack of regard for safety and capacity issues. The individuals who passed away, ranging in age from 9 to 27, succumbed to compression asphyxiation, which is comparable to being crushed by a vehicle. Scott, Live Nation, and the other parties denying these allegations, stating that safety was their top priority, and they were unaware of the circumstances that led to the tragedy. The grand jury declined to press charges against Scott and five others linked to the festival after investigating the incident.
